D-1-GN-25-003485 - EX PARTE, - BLAKETREE MUNICIPAL - UTILITY DISTRICT NO. 1 - OF MONTGOMERY COUNTY - IN THE DISTRICT COURT OF TRAVIS COUNTY, TEXAS - 200TH JUDICIAL DISTRICT - NOTICE OF PROCEEDING AND ORDER - The Court issues the following Notice of Proceeding and Order pursuant to Chapter 1205 of the Texas Government Code. - NOTICE IS HEREBY GIVEN to all persons who (i) reside within the territory of Blaketree Municipal Utility District No. 1 of Montgomery County ("Blaketree MUD No. 1"); (ii) own property located within the boundaries of Blaketree MUD No. 1; (iii) are taxpayers of Blaketree MUD No. 1; or (iv) have or claim a right, title, or interest in any property or money to be affected by the proceedings described below and/or the issuance of the declaratory judgment described below. For purposes of this Notice of Proceeding and Order, the persons named in sections (i), (ii), (iii), and (iv) above shall be referred to as the "Interested Parties." Notice shall be posted as required by Texas law. - Per an election held on November 8, 2016, Blaketree MUD No. 1 has voter approval to issue unlimited ad valorem tax road bonds totaling up to a maximum of $70,000,000, of which Blaketree MUD No. 1 has previously issued road bonds totally $890,000. From its remaining $69,110,000 in voter-authorized but unissued road bonds, Blaketree MUD No. 1 now intends to issue unlimited ad valorem tax road bonds totaling no more than $20,000,000 (the "Series 2025 Road Bonds"), and, from time to time, in one or more issues or series, Blaketree MUD No. 1 may issue additional road bonds under the same circumstances that, together with the Series 2025 Road Bonds (collectively, the "Road Bonds"), total no more than $69,110,000. The funds generated by the sale of the Series 2025 Road Bonds will be used (1) to reimburse the developer of Blaketree MUD No. 1 for funds expended on Blaketree MUD No. 1's behalf for designing and constructing the macadamized, graveled, or paved roads, including storm drainage of those roads, and associated landscaping, lighting, and beautification within the boundaries of Blaketree MUD No. 1 and related land acquisition costs; (2) to provide reserve or contingency funds; and (3) to pay all costs incurred in the issuance of the Series 2025 Road Bonds, all as authorized by the Constitution and laws of the State of Texas. The Road Bonds will be direct obligations of Blaketree MUD No. 1, payable from, and secured by, ad valorem taxes levied and collected by Blaketree MUD No. 1. - The entryway into Blaketree MUD No. 1 from the adjoining public road, FM 1486, is secured by a security monument and checkpoint. Proceeds from the 2025 Series Road Bonds will finance the construction, maintenance, and management of roads within Blaketree MUD No. 1 that are located behind the security monument and checkpoint. Via this secured entryway, all landowners and residents of Blaketree MUD No. 1 and their invitees, as well as firefighters, firefighting equipment, police, and other emergency vehicles of whatever nature, at all times, may access the roads within Blaketree MUD No. 1. All vehicles entering Blaketree MUD No. 1 must identify themselves at the security monument and checkpoint, with the exception that firefighters, firefighting equipment, police, and other emergency vehicles of whatever nature may enter at all times. The construction, maintenance, and management of the security monument and checkpoint will not be funded with proceeds from the Road Bonds. - Blaketree MUD No. 1 has previously issued bonds with the approval of the Attorney General of the State of Texas. As such, the Attorney General previously approved the subsidiary questions regarding Blaketree MUD No. 1's ability to issue public securities pursuant to Blaketree MUD No. l's elections. In this case, Blaketree MUD No. 1 does not seek declarations that it has the authority to issue public securities generally, or the legality and validity of Blaketree MUD No. 1's elections and or taxing authority, as those matters have already been decided by the Attorney General. The declarations sought in this case are specific to the Road Bonds pleaded and as stated above in this Notice. - As such, Blaketree MUD No. 1 has filed an in rem action for declaratory judgment (the "Petition") seeking, among other things, the following declarations: - (1) Blaketree MUD No. 1 is authorized to issue its Road Bonds; - (2) the imposition of ad valorem taxes by Blaketree MUD No. 1 is legal and valid; - (0) the ad valorem tax revenues pledged to secure the Road Bonds are legal and valid; - (1) Blaketree MUD No. l's proposed expenditures on roads within Blaketree MUD No. 1 are legal and valid; and - (2) the Road Bonds are legal and valid public securities. - A full description of the lawsuit and the relief sought is contained in Blaketree MUD No. 1's Petition, Ex Parte Blaketree Municipal Utility District No. 1 of Montgomery County, Cause No. D-1-GN-25-003485, filed in the 200th Judicial District Court of Travis County, Texas. - IT IS HEREBY ORDERED and Notice is hereby given that any Interested Party or the Attorney General of the State of Texas may become a named party to these proceedings by pleading to the Petition on or before, and may appear for hearing and trial in the courtroom of the Judicial District Court of Travis County, Texas, at 10:00 a.m. on Monday, June 23, 2025, it being the first Monday after the expiration of 20 days from the date this Order is issued. - You are hereby on notice that Travis County operates on a Central Docket and the location and courtroom of the hearing may be moved to ensure your matter is reached on this date and time and with any available district court judge. - Assignments will be posted Friday of the week before the proceeding.
